Could businesses be sued for texting employees who are driving?

Attorney Steve Gursten, who heads Michigan Auto Law and lectures on this legal concept of "remote texter liability," said he believes that as distracted driving continues to be a cause of auto accidents, businesses in Michigan could eventually become legally liable in negligence cases linked to texting.

$10M Florida settlement

..The texting was discovered after the injured person's attorney downloaded the driver's cellphone records. The case was ultimately settled for $10 million, Gursten said.

Police begin enforcing Washington's distracted driving law

The Associated Press January 03,

The new law was enacted by state lawmakers last year, and it was initially set to take effect in 2019.

Gov. Jay Inslee pushed for the law to take effect in July 2017, but instructed law enforcement agencies to give drivers a six-month grace period in order to adapt to the new law.
