There is no such thing as a smoking gun, that is what discovery is all about; any judge worth his salt would have to dis-allow a smoking gun that was not put forth as evidence durring discoveries.

It is just my feeling, but I am 100% right. AMD is desperate to show good news right now. Plus, the tactical advantage in this instance of using it as a surprise is not good.

Legally, IF this were the type of evidence that might be used as "impeachment" evidence, well then maybe they would try to hide it.

Not only that, unless it is impeachment, it is discoverable by Intel and IF it existed, Intel would begin a campaign NOW to soften the impact. Or if it is "colored" testimony from a "friendly" disti to AMD, then Intel would have a right to have AMD disclose it NOW to Intel so that Intel could line up its ducks to discredit the "testimony", if any.

The only thing that is of consequence right now is this "story" by BetaNews.com that says discovery was halted. If that is the case, then AMD has not even had the chance to uncover the smoking gun.

But I can find nothing which agrees with the statements made by this "news" source.
