you think they have money to call preferred? lol, they don't!

This is another reason I see an attractive junior preferred to common conversion being offered: it can settle the lawsuits if it accompanies enough other reforms (assuring current junior pref holders that the commons will actually be worth something in the future), and more importantly it costs no cash.
