Since we do not exactly know what took place here there needs to be a discovery team to find out exactly what,how and why did happen this way. Then and only then we would know the cause and that's when the clock starts ticking if I understand this correctly...

There are times when a person is unable to discover that they have been injured. For example, fraud that is hidden by the perpetrator of the act and is not easily discoverable.
