Whether a company is an SEC registrant or not isn't a factor in suspensions. Unless, of course, the issuer is delinquent with its financial reports and is suspended for that. But MGTI is current, so it can't be suspended for that.
If the SEC takes a look at MGTI, it'll be to make sure its disclosures are "not misleading".
