I read it again and a MM hiting a bid isn't publishing a quote solicited or unsolicited. If it is not illegal it would be nice to know the fine and how likely it would be that an audit would uncover the activity. If it says a MM can't hit an unsolicited bid without having a unsolicted sell order in hand, just quote that part, because I can't see it.
