While not a guarantee on how the en banc court will rule, that is good news. Thanks for posting that 3antar.

To more fully consider what the ruling means for the FHFA, it is suggested to read the CADC decision against the CFPB (see pages 29 and 33 for FHFA references) and listen to the oral arguments (at 0:10:58 to 0:18:40; and 0:18:40 to 0:26:02 and 1:05:00 to 1:11:30) where the FHFA and GSEs are briefly mentioned and details the CFPB argument that single director agencies are ok (0:18:40 to 0:26:02). CFPB found only three agencies similar to itself: Social Security Administration, Office of Special Counsel and FHFA.

Please note that Theodore B. Olson of GIBSON, DUNN & CRUTCHER LLP, who is the lead attorney in the Perry Capital case, is the attorney arguing the case and representing PHH....
