Yes, there is a ban. However, the Congress cannot declare the value of the Senior Preferred. If the SPSPAs are declared null and void ab initio by a court of law or amended or rescinded by the parties per SPSPA 6.3, 6.7, and 6.12, the congressional ban is toothless.
