The court case is between HJOE and KBM Worldwide (don't know why I wrote "KMA" in my earlier post).
Should HJOE decide to file a Form 10, it will need to include information about it. Many companies are involved in litigation of one kind or another, so in itself it's not a determining factor. Recently FINRA has sometimes refused corporate actions to companies involved with Curt Kramer, but I don't know how they'd treat the matter in connection with a Form 211.
In any case, the Form 10 comes first.
