"Possession" means to hold or have. "Steal" means to convert the property of another to one's own use. "A license to develop" is a permission to use something to develop it.
If cloudncode and/or the fellow who is upscailing the archive from the time and motion study pioneer is using some software with VDK 2 licensed code in it, would they not be in possession of the code? Yes. Would they be they be in possession of the license to use it to develop new tech? No.
I once drove a Toyota corrola. I possessed the technology. I didn't have a license to use the technology by copying it. See the difference?
Tmm came in to possession of the code when Iterated provided it to a confused and likely faithless agent who agreed to put the license in to a company other than Tmm. That's dumb and possibly worse as was Tmm paying to acquire DFI. I'm hardly apologizing for that chiefly or otherwise.
