It's actually pretty sad. It's apparent that Cavanaugh, Kozole and Ford didn't do one ounce of due diligence on this case. It's regrettable that their attorneys wouldn't step in and caution them about going down this path. Then again, attorneys want billable hours and probably didn't bring up the 2002 case that TMM and Simpson were parties to.
I posted before that Neff (TMM's corporate lawyer at the time) was on a scorched Earth policy of suing everyone involved prior to the new TMM group. He unfortunately filed a lawsuit against a party/competitor that didn't acquiesce.
I feel sorry for all of the large TMM private placement people. They were probably told many untruths.
