Who told you the company is not buying back in open market. They have done the same on previous buy back and as far as I know they are doing it again. They never said they will not buy in open markter, all they said is they will follow "all repurchases shall be effected in compliance with Rule 10b-18" and Rule 10b-18 restrics buying in open market but does not prohibit.

If the company has hit oil then why has the stock not climbed????
