It means that DB will share, pro rata, with the senior noteholders

Explain us, where did you come up with this pro rata split?

Suppose the FDIC has agreed to an unsecured claim to help alleviate JPM's obligation to DB at the expense of the senior note holders. If I were a senior note holder I would want. a court to decide if DB gets any money earmarked for the senior note holder. Have not heard from senior note holders on this issue yet.
