I'm not a lawyer and I didn't stay at a Holiday Express last night but I do have some concerns about this 3-1/2 year old case. Obviously for a small company that has to spend a majority of its cash while taxing an inordinate amount of time in defending itself against a now dubious lawsuit, what's the price of that? What's the nominal dollar amount on investments that weren't made due to the suit? If this gets to a jury I think that award may be much bigger than one might think.
