This may not be all that coherent and I apologize. (I ‘ve been drinking today after making a hole in one. I bought 29 players drinks. That was an expensive shot. But good fun.)

The CC today was the worst I ever heard by imclone. No wonder the price went down 5%. I wish someone would shut Howie up, after the accounting numbers are presented. Joe Fisher comes in second to last place. Can you say no comment in more ways than Joe did. Geez the Ceo should answer the questions, the shareholders own the company and we have the right to know. Give us, the owners some guidance. Or at least get a ceo who can talk to the analysts, this guy makes Sam look like a golden tongue, and Sam stammered. Ron Martel should be named CEO, without a doubt he is the only one that knows what is going on and can talk. Ron handled all of the analyst questions with grace and honor. Even when he told them, that we are not providing that information. I’m very disappointed that he would not give a breakdown on the penetration rates, but he at least explained that to do so would give the competition ( amgn) information that could lead to pricing pressure.

The yeda suit. Think about it. Who is inventor doesn’t matter, win or loose. Because the patent will never hold up as being valid. Imagine a new MAB when combined with Chemo that cured cancer. Would a lawsuit that declares this new mab invalid ever hold up in court, because it violates Aventis patent. It is obvious that no single mab can be considered as the patent holder on combo therapy, especially if it is inferior. So far the combo patent will hold because erbitux in combo is the superior therapy. Panitumimab can’t break the patent , unless it is proven as superior. Think about that. It’s not the patent that’s important, its which mab that proves superiority that’s important. The rest is legal, political mumbojumbo.

Sales. Even though sales beat expectations for Q2, they showed flat sales month over month may to june. Does this mean that H&N sales have peaked already? Not according to Ron, but I wonder why month to month are flat. Analysts also are wondering about monthly sales rate, I think there was some disappointment, and we go down 5%.

Buyout/merger/alliance. Help us please, we be waiting 6 months. Throw us a bone. Not a word. Whats that all about. We get more info from Corky and Walk...and they know next to nothing. Except rumors and speculation.

Merck KGaA increase in worldwide royalty. I need to run these numbers but on the surface it does not seem like such a good agreement. The Imcl agreement with Merck was for a royalty in Europe and a split with sales in Japan. A 2.5% increase in worldwide sales royalty does not seem like a 50-50 split with Japan. Maybe I don’t get it.

PS. this board is great with biowatch as moderator, keep up the great work. I don’t mind reading all posts, when the likes of onc_doc are deleted. big improvement....kudos
