Who are you?
An anonymous contributor.
And how do you see this ultimately being resolved?
Since I do not have precognitive abilities, I cannot see future events. I genuinely cannot answer that question.
(if by the courts, which court do you see has the best chance of success)
This is also a difficult question to answer. These cases require a high degree legal, ethical, economic, political and social intelligence, penetrative insight, and judicial acumen. The later achievement also requires consciously recognizing and putting aside biases of all kinds.
The legal stands and adversarial positions taken and briefed by the Plaintiffs' and Defendants' attorneys plainly reveal what the Plaintiffs and Defendants wish to achieve and the quality of the attorneys' efforts. However, the qualities of the judges and the law clerks that assist them in the background via legal research and the writing of opinions are not an open book. I have not made an effort to review past legal decisions and opinions of the presiding judges in these cases or to discover the identities and legal contributions of their law clerks. So, instead of clear knowledge and analyses of the presiding judges and judicial clerks there is only wonder and waiting to see where and when acute intelligence, clear insight and juristic acumen will appear.
