If you read deeper in the appeal, you will see how the court and the SEC committed perjury in order to try and keep the actual, audited financials of the company out of the court case.

That's frikkin hilarious, besides the obvious ... The last audited financials was the 10K circa 8/22/11 - While the last communication via 8K was on 10/9/13. Maybe the resident dog at the SEC ate the 2012/2013 10K's?
