They WERE NOT required to do the recent filing. It was done in response to shareholder request.

The hell are you talking about? Any serious company files QUARTERLY financial statements. And FYI - those are for through year ended June 30th. A good portion of the recent "volume" has come since their year ended, so draw your own conclusions as to whether the 90 million o/s is still 90 million o/s.
