Its a cash swap settlement this month. no shares involved.

That is what may be Ackman's hope for his arrangement. What the market does depends on the near and immediate market conditions (short interest, bulls vs. bears, Ackman's and other large holder moves, prop shop and retail interest, media reports, the court cases, etc.).
