Whether or not there is anything patent pending about the current formula, I can vouch that it does produce "a maximum CBD effect unlike anything else currently available".
I think the patented stuff will come with the EM-J and a new thinning fluid although they may also have some patent pending on the current formula as well. As I recall, the USPTO doesn't immediately publish patent applications.
