If the judge considers them to be part of equity, then they would likely become part of the OBS pool and subordinated as the rest of equity. They apparently tried to claim an end around as its part of their comp, but in reality such comp is normally based on current value the time the options are vested. Right now, they're then worth the same as any common equity share, behind preferreds if the pecking order is still upheld.
