Understand, I'm no (in NO way)expert but the thing is more of interest to me as a patent law issue than as a catalyst to stock prices. One of the comments to the article said that this would be studied in patent law classes for years.
Some of the issues which may have carried over from the IDIX suit;
It won't stop anything, and the issue will be tied up for years in suits, appeals, etc. It will be business as usual, IMHO.
It isn't clear who will win, so obviously if Gilead wins there would be no effect.
I'm not sure it will even come to a win or loss, but a settlement. In the case of IDIX suing Gilead some people (IDIX investors off their meds) thought that IDIX would end up "owning" Gilead. Most detached experts though it would possibly amount to a "small" non- crippling" out of court settlement.
I would not advise selling to get out of Gilead, but if it were so that the market reacted, it might be a good time to fill in GILD stock. : )
Like I say this is old news, not breaking news; which is why I replied to my old comment. It was discussed here a while ago. I seem to recall hearing of it about 10 months ago.
This is not a news article I would react to with a buy or a sale of either stock. It is something that is out there and it is interesting, good to be aware of it.
I can't remember if I mentioned it in an earlier post; some other enterprising people copyrighted the term "Material Girl", well after Madonna's song came out. She made the term famous, but guess who owns the rights? There was another such case; "Californication", which was a TV show which may have borrowed from the song by the same name by the Red Hot Chili Peppers, who made it popular. It turned out they had no right to the term as it was used back in the 70's; public domain.
Just a little local color story, not one to trigger buy or sell orders, IMHO. Maybe others with more experience see it differently, but that's my guess.
And last year many people took the same type of GILD insider selling as a signal that Gilead was going to lose the suit to IDIX. (so far it hasn't that I'm aware of, but MRK still pending)
