If testimony is completed Thursday, I would not be surprised if the jury reports out by Friday aft. Juries normally don't want to stay in session on the weekend if possible.

I spent a couple hours this afternoon in Courtroom 6A. It was pretty much the dullest two hours of my life and I am surprised that I came away able to answer one of your questions. There were 8 jurors in the jurors box. Maybe alternates sit in the box, I really don't know, but it looked to me like it was an 8 member jury.

I concur with Technical's?? assessment of the jury but regardless of how intelligent these folks appear I think the technology in this trial is way, way too complex for six lay people to grasp. It is way too complex for me and I have been invested in IDCC since before the first big run up (1999-2000??) and have read this and previous boards regularly. I may not be the brightest bulb but somehow I managed to get a degree in chemistry so I don't think I am the dimmest bulb either. My guess is whatever decision the jury makes will be based more on who comes across as honest and believable and less on the evidence.

I listened to our female lawyer ask questions of a Dr. Haas??? He seemed
very knowledgeable and well prepared but his heavy accent made him a bit difficult to understand. Our lawyer asked him a couple times to speak more slowly. At one point he used a verbal illustration to try to simplify a point he was making. I understood the point (at least I thought I did) before his little story about Honda Civics but after his story I had no idea what he was trying to say.

There was no cross while I was there but when the jury was dismissed for a break there was a bit of a pissing match between the lawyers. The ZTE lawyer claimed IDCC introduced evidence the judge had ruled as inadmissible and that they, ZTE, had been concerned IDCC would, in fact, introduce that evidence even though the judge had ruled it inadmissible. Our lawyer quickly took the mic to say that ZTE was absolutely wrong and she had the slides at her fingertips to prove her point. I think we scored some points on this with the judge but as I said the jury was on a break. This is the kind of thing, had it happened in the jury's presence, that would have made an impression on them.

As I left I chatted with a lawyer who had been observing the trial but was not associated with either ZTE or IDCC. He said he thought IDCC's lawyers were excellent.

I wish I knew when closing arguments were going to be. If I knew I would try to attend but all the technical stuff is pretty tough to take.

BTW we had a lot more lawyers than did ZTE so if it comes down to a physical brawl I think we have the edge!
