He admitted his guilt. The guilty plea, with admission to those two counts, was what was required of him to dismiss the other counts in the indictment.

And no, he's not trying to reverse the decision, just the sentence (2 years). He doesn't seek to vacate the guilty plea at all, because if he did, all those other counts would land on his head.

His lawyer's arguments, strangely enough, aren't total nonsense. The gist of the argument is that the prosecution and the judge brought in the costs of the counts in the indictment in computing sentencing, and they're saying that's dirty pool. The government claims that's standard practice.

I have no idea if Foley's lawyer's argument holds any particular weight. I have to say that first I'm annoyed with the government for making these 30+ count indictments and then forcing defendants to admit guilt to some of them just to avoid spending their lives in prison, but I'm much more annoyed with criminals who have enough money from their various nefarious activities that they can hire fancy lawyers and never suffer the consequences even when they get caught doing them.

Dangfool!! So he's already been found guilty he's just hoping the 9th circuit reverses the decision.
