[OT] Probably fairly easy to get around by selling the assets to a pre-existing foreign subsidiary or entity instead of to a newly created one. The WSJ also makes the point today that US companies will simply continue to avoid US taxes on foreign earnings (paying only the foreign taxes) by continuing to keep the earnings offshore and out of the US economy.
