Actually, all this is probably much ado about nothing.
From reading Gild's 10Q last nite, it said that the US PTO has already ruled against Abbvie "first rule of inference" or something of the sort.
I don't want to waste my own time to understand legalese but it looks like Abbvie's combo patent won't amount to shit.
Because if it were true, then any company can prohibit any other competitor from using a combo of their own compounds in any combo they wish, just because it filed a combo patent first. The only requirement is that the list includes all the possible compounds at the time of application.
What a load of crap if this legal argument is allowed to stand. My common sense is throwing up all over myself :)
