Exactly right. As far as I can tell, there isn't any way to avoid this, and I am not suggesting any agreements against porting to the competitor later on.
But also remember that the opposite holds true. Any vendor who spends time to port software to x86-64 shouldn't have a problem porting it to IPF later on.
