The way I read the transcript, Judge Jordan hasn't decided EITHER issue. It appears that the briefings/responses back and forth aren't in yet for the venue change to NDCA, and MU's response on the motion to enjoin is due today with RMBS's counter coming back to the Judge tomorrow or so. Judge Jordan will consider BOTH at the same time.
It would be pretty easy for him to 1) send the case to Judge Whyte and 2) in the meantime, MU, stop the one in EDVA in one
fell swoop. If he does, it would be a major victory for RMBS.
Is he up to the task?
