Which federal agency would regulate it and under which law? If it's a new law we're years away from establishment, and up to another year before enforcement. Not sure how grandfathering works, but I'm hopeful the ecig lobby will be strong enough by then to influence some things.

You are 100% wrong. mCig is regulated just as a lighter is regulated by CE Mark in Europe and RoHS anywhere else. This similar to DOT standards. The FDA would only step in if a regulated or scheduled compound was being delivered/administered.
