I think most people can pretty easily see through what the guy is saying. He's pointing out how in a "free market" these regulations don't make any sense.
Creating a logical argument for why government regulatory action doesn't make any sense is as easy as shooting fish in a barrel. The question is whether or not they'll change the regulations as a result. The author of the article addresses that to some extent by saying further changes may be challenged in court and does not, in my opinion, paint a compelling argument for any near term changes that would negatively effect biofuel prices.

I believe there are more instances of the abridgement of freedom of the people by gradual and silent encroachments by those in power than by violent and sudden usurpations.
