The Fairholme counsel for the US Court of Federal Claims case is found below. it is not Ted Olson.

The Plaintiff's filed a complaint in US Court of Federal Claims, presented arguments and prima facie evidence to support their case. The Defendants filed motion to dismiss the Plaintiffs case. The Plaintiffs filed a motion to suspend the dismissal and to open discovery to find facts that only the Defendants possess. Judge Sweeney granted the Plaintiffs' discovery request and suspended the Defendants' motion to dismiss. The Defendants filed motions to suspend discovery and to end the suspension of their motion to dismiss and for reconsideration. Judge Sweeney denied the Defendants' motions today on MArch 19, 2014.

The discovery schedule will be presented on Friday, March 21, 2014.

So far, the Defendants have failed to convince Judge Sweeney to dismiss the complaint and suspend discovery. The reason for this is that their legal argumentation is self-contradictory, entitled, tortured, confused and disorganized and their presentation of their administrative records were non-informative and to a degree uncooperative. More able counsel could have made a significantly better effort though it is unlikely that the result would have been much different.
