Yes, I did say that. Normally discovery has a cut off date and if you go past it, it won't be entered. I know that the defendant had to file a reply on (I believe August 2nd), was a little late and the court wouldn't allow it. You posted about this yourself.
This next step was supposed to happen in December, now it's in April. I wonder why the court's keep complaining about being backed up and overruns in costs? Shocking.
A case my company was invloved in three years ago was supposed to take 2 weeks. It lasted 5 weeks due to so many "dark days" with the court. Needless to say the jury was worn out with it.
