Hard to draw any conclusion although I agree with you, on the face of it this seems like a technical issue that should have a relatively easy answer but given that the judge queried Activision lawyers about harm and they had no answer, perhaps not as easy as I think. Regardless, the continuing onslaught of criminal cases seems to push IP cases to the side for these judges...let's hope the recent motion by WDDD at least reminds Casper to do something.
