Why do you think MFR is behaving as if there is no exclusive (or non-exclusive, for that matter) agreement with Scanbuy?
Again though, it doesn't matter if MFR has an exclusive or non-exclusive agreement w/ Scambuy, as long as they have an agreement w/ them for their patents, that' what matters.
2.4. The Scanbuy sublicense to NeoMedia in this section is expressly conditioned upon Scanbuy fulfilling its obligations under the “Exclusive Patent License Agreement,” dated March 5, 2008, between Scanbuy and MFR, provided however that Scanbuy shall take no action to terminate the Exclusive Patent License Agreement solely in order to terminate the sublicense granted to NeoMedia herein. The sublicense to NeoMedia granted in this section shall subsist so long as Scanbuy has a license to MFR Licensed Patents.
And, again, we know that Scumbye and Marshall are in bed together w/ an agreement because they told us on 9/30 they were.
May it be a case of NeoMedia giving MFR all the rope they need to hang themselves? Looks that way to me.
Desperate and apparently very frivolous lawsuits MFR is tossing around given the wording above in section 2.4 of the Neo/Scum/MTT settlement and agreement.
As I said before, nobody accused 'ol MTT of being reasonable or apparently smart, either.
