1. The quoted clause does exist in the settlement agreement.
2. MFR was suing without Scanbuy well before NeoMedia terminated the agreement.
3. NeoMedia was unable to challenge MFR under the original agreement.
4. NeoMedia has not challenged any termination of the MFR/Scanbuy exclusive license.
5. Wendy’s will respond to the suit. They may do so with a settlement unless they already have a license.
6. If Wendy’s has a MFR patent license, this is good for the Wendy’s to defend against the MRF infringement suit. You can not infringe a patent which you own a license. Crazy stuff.

These are all facts.

They, however, do not lead to a singular conclusion.
