District court battles -- the motions are flying fast and furious, what it means I'm not sure. There are two things going on, a battle over the entry of judgment and a battle over an award of sanctions against Amphastar for their misbehavior during discovery. Momenta is seeking $1 million in legal costs.

There was a hearing today, the judge is taking it "under advisement". Here are the electronic clerk notes:

01/08/2014 561 ELECTRONIC Clerk's Notes for proceedings held before Judge Nathaniel M. Gorton: Motion Hearing held on 1/8/2014 re 521 MOTION for Order filed by Amphastar Pharmaceuticals, Inc., Actavis, Inc., International Medication Systems, Ltd., 507 MOTION for Entry of Judgment under Rule 54(b) filed by Watson Pharma, Inc., Amphastar Pharmaceuticals, Inc., Actavis, Inc., International Medication Systems, Ltd., 392 Emergency MOTION for Contempt and Sanctions Against Defendants for Their Willful Violations of Court Orders (RE-FILED BY COURT ORDER) filed by Momenta Pharmaceuticals, Inc., Sandoz Inc., 530 Emergency MOTION Emergency Motion to Defer Consideration of Amphastar's Motion to Enforce Liability on the Bonds Pending Exhaustion of Appeals filed by Momenta Pharmaceuticals, Inc., Sandoz Inc. Court hears arguments of counsel and will take the matter under advisement. I'm not sure what is REALLY going in and whether there is some deeper game afoot. I may try and get the transcript of the hearing, if I do and learn anything of consequence, I will post about it.
