Newby means nothing today but a claim.

If present day Q can muster the cash to go after him, they can. About as much of a claim as going after Jeff and CET. It won't go away.
But it means nothing wrt to the Q day to day now. Does Q want to go after Newby? Can it afford to go after him?
I'd rather the Company to spend its limited cash on compliance.
