the answer is: I believe you are caught in antiquity.....the courts and decisions are constantly changing....
idem sonans to which you refer carriers little gravity in modern/recent times and does vary somewhat from state to state....it's really more of a common law thing than a statute....
my attorney (long ago) told me that for the sake of a given contract you can spell your name g-r-e-e-n and pronounce it smith....that's your right.....but for the sake of the contract, you cannot evade it should someone write your name as smith the way you pronounce it.....
