J&J acquired two generic strip manufacturers after suing them. J&J settled with a 3rd generic strip manufacturer after suing them. The two companies they acquired made out great. The third company continued to sell their product for a number of years, so in a sense the third company made out too.
On the other hand none of the three companies was able to put J&J on the mat like DECN has. My partner is an IP attorney and amateur sleuth. He believes that J&J can settle the suits by agreeing to settle the cross complaints and then dropping their suit.
I believe that settles the "can they" issue, but leaves open the "will they" issue.
