Since Activision is jerking Worlds around with their baseless last-minute motion for summary judgment, I wonder if Worlds will seek a preliminary injunction to restrain Activision from releasing Ghosts.
Once the USPTO issues a certificate of correction for Worlds' '045 patent, Worlds will be in good position to prove the 4 requirements for granting a preliminary injunction:
* The plaintiff has demonstrated a reasonable likelihood of success on the merits of the case (i.e., that the patent in issue is valid and infringed).
* The plaintiff will be irreparably harmed if the injunction is not issued.
* The threatened harm to the plaintiff outweighs the harm the injunction may inflict on the defendant.
* The injunction will serve the public interest.
Call of Duty: Modern Warfare 3 made $1 billion in its first 16 days of release (a day faster than the movie Avatar did). I don't think Activision would want to jeopardize their upcoming release. Perhaps a motion for preliminary injunction would bring them to the table sooner rather than later.
