Usually in my work in finance I have seen the if there is enough evidence during discovery various authorities SEC, or any other securities relate authorities tag on and start their own investigation side by side.

We're not suing for fraud, but it will come up and thats all that's needed, it will also lead to a quick entrance from the right authorities and action ; which at the moment may not happen the SEC is not very diligent on penny stocks without obvious evidence they just don't have the funds to go after penny stock investigations its not worth their limited resources.

There were plenty of mid size banks committing fraud during the credit bubble, but until people started to sue , authorities did little but once it started it they jumped on board. I am hoping evidence comes out during any investigation, and then its a double whammy
