The magistrate judge, in her Report and Recommendation is not in compliance or when she files a faulty proposed or erroneous findings, the judge or court can rule in Petitioner's behalf. In the initial filing to this court post-trial, Petitioner presented all facts and factors sufficient enough for this court through its magistrate judge to make a finding and recommendation of dismissal because the facts rem ain undisputed. At any time before the close of record, a party may move for Summary Judgement as to all or any portion of the case, on the grounds that there is no genuine challenge as to material facts and petitioner is entitled to a decision in his favor as a matter of law. The material facts believed to be undisputed are outlined throughout petitioner's Response to magistrate judge Opinion and Recommendation (28 USC 636)(A)(B)(C) and Local Rule 72. The facts of the case are clearly explained: conspiracy, insider trading violation of SEC Rules and Regulations, Fraud, illegal profitting, illegal share trading, naked shorts, false allegations against Conversion Solution family members of illegal share trading and enrichment, violation of constitutional rights, and Federalism:
