One of the major differences in our case as opposes to this one is that I do not see verbiage in our case (unless I am missing it) that states the preverbial "all or substantially all". Our terms simply state any successors thereof there were two successors in that Barclays assumed substantially all of the North American assets while Nomura took over the European and Asian divisions. I cannot wait to hear a reply from Lehman's attornies...
