That's Simply Not True. Patent Infringing PEIX joins a list of producers, several of which have already settled and licensed with GERS. Center Ethanol was the 1st to settle and license their ICM equipment with GERS. The CEO of Center is on the BOD of GPRE, and of course all of GPRE's equipment, including ICM's, is licensed with GERS.

Amaizing Energy is the most recent settlement. They basically went bankrupt defending against the lawsuit. GERS' 2nd largest customer ANDE/MPC, settled the lawsuit with GERS when they purchased the infringing Amaizing Energy plant. This plant was infringing with Edeniq's equipment.

Calgren, of California was infringing with ICM's equipment but licensed with GERS without the need for a lawsuit.

Likewise, Marquis Energy was infringing but licensed both plants with GERS without the need for a lawsuit. Marquis went on to say... "GreenShift invented and patented its corn oil extraction processes, and the superior process knowledge and technical expertise of GreenShift’s team is clear."

Also named in GreenShift’s pending infringement suits are ICM, Inc., of Colwich, KS and GEA Westfalia Separator, Inc., of Northvale, NJ based on each company’s alleged infringement via the sale of equipment for use in a manner that infringes the ‘858 Patent.


The question how much of shareholders money will patent infringing PEIX burn defending against GERS' solid family of patents? This expensive lawsuit will make them that much less profitable than respectable companies like GPRE, ANDE, MPC, BIOF, who GERS has pledged to protect the competitive advantage of.

NK needs to step down or be voted out before he drives this company into the ground, leading to another BK.
