The issue as I understand it relates to holding companies whose only assets are royalty interests. The '40 Act is meant to regulate passive holding companies and mutual-fund type entities.

Just a related question. When PDLI discontinued being an active biotech was there a regulatory reclassification for the company?


Edit: The company's profile suggests PDLI is still actively developing MAB's. I thought they were strictly an IP/royalty bearing interest.
