No they can't. Neither the U.S. nor Canadian authorities can tell a company how to run its business. If the company is, like BOPT, an SEC reporter (or a Sedar filer) then they can punish it for not making required filings. They can suggest that a statement of some kind would be a good idea. But they can't order the company to do it.
