BME Litigation Update: no deltas as of 5/7/2013 at 5:00 a.m.

Under the terms of the order dated March 7, 2013, the case is dismissed with prejudice because nothing to the contrary was filed within 60 days of that order:

DISMISSAL ORDER

It having been reported to the Court that the above-captioned matter has been settled,

IT IS on this 7th day of March, 2013

ORDERED THAT this matter be and hereby is dismissed without costs and with prejudice, subject to the right, upon good cause shown within sixty (60) days, to reopen the action if the settlement is not consummated.

BTW "prejudice" here means that the dismissal is final, and the case cannot be brought again later. A case dismissed "without prejudice" can be re-filed later, provided that the party can correct whatever lead to the dismissal.

I updated the online docket with an indication at the bottom of the page that the search was through May 7, 2013: http://client-email.com/dockets/PCFGvBME.html

Anything filed on May 6, 2013, would already be online by now (it is pretty much instantaneous, actually). Instead, nothing has been filed since the order on March 7. So we are done.

Good luck everyone,
BD

P.S. Here are the usual caveats:

Couple things:

1. The docket (including links to a subset of the filed documents) is available at http://client-email.com/dockets/PCFGvBME.html ; if anyone wants documents not linked, please feel free to let me know.

2. I am not your lawyer unless we have a written engagement letter, signed by both of us.

3. I have not had a chance to review the documents. Too busy, plus this really is not my area of law. I am sorry about that. One thing to keep in mind as you read them is that you (like the judge) must distinguish between advocacy and accuracy. In other words, reading just one side's papers may sound very convincing. By the same token, reading the other side's papers may sound equally convincing. But only one side is going to win on any given issue.

I still look forward to taking a look at these myself, and I have not checked each link. Let me know if there are any technical problems; let your lawyer know if you have any legal questions.

I am an amateur at this, and it would be unwise to rely on my opinions without your own independent confirmation in consultation with an investment professional.
