And when the guidance and reporting are just not true or valid nomore?, then no update are necessary?

I'm not aware of any public companies that update guidance between reported periods. Companies either meet, or miss guidance. They don't "update" it.

Not updating investors of a changed Capexplan are rightout deceptive and probably worsen circumstances and faith considerably.

I'm not aware of the actual CAPEX plan having changed. Poor market performance has more to do with additional share issuance than it does an increase in actual CAPEX.

Management stated on November 19th in the last conference call that it would utilize the remaining 100M authorized and would seek to raise the authorized. The CEO also stated to expect similar share issuance in 2013 as 2012 unless alternative financing could be secured.
