It appears that we're good to go on the legal aspects of getting the Kevetrin listed as a "breakthrough therapy" assuming it meets the legal requirements.
Below is the response I got from my guys on the Hill:

The bill S.2236, the Advancing Breakthrough Therapies for Patients Act of 2012, has not progressed because the legislation was included in and passed as part of S.3187, the Food and Drug Administration Safety and Innovation Act. You can find full details on S.3187 at http://hdl.loc.gov/loc.uscongress/legislation.112s3187, and you can find the language on breakthrough therapies in the bill by loading the full text of the legislation and reading in Section 902 (a CTRL+F search makes finding that section much easier)."
Let's hope we get to the point when CTIX will be grated such status!
