Actually Obama made an executive order that all waste-to-energy is now defined as renewable energy:

"President Barack Obama signed an Executive Order that defines waste-to-energy as a renewable energy source."

Now while JBII currently processes industrial waste, not municipal solid waste, it ultimately is municipal solid waste at least in Niagara Falls because their permit only allows for landfill-bound plastic therefore by Obama's definition JBII's P2O = renewable energy.
